High Court action is being launched next week to try yet again to stop the deconstruction of Christ Church Cathedral.
The Great Christchurch Building Trust wants the court to look at whether the Anglican Church has the power to demolish the building, which suffered damage in the earthquakes.
Trust co-chair, Jim Anderton, says they have advice that under the Act that the Cathedral operates, the trustees do not have the right to destroy the building or deconstruct it - they have the right and the obligation to repair and maintain it.
Jim Anderton says going to the High Court to have the point of law looked at is the quickest option possible.
“Its a declarity judgement on the law and since not a whole lot of people will be giving evidence over weeks and months - it'll be quick and sharp.”
He says this is now the only way to get the Church to talk to them.
“I can’t say for sure what they’d say, but it could be some compromise whereby the church and other entities like ourselves are asked to work co-operatively to try and work out a solution - and that’s all we’re wanting.”
Jim Anderton says a High Court application to have the point of law looked at, will be filed next week.
